These Terms of Service govern your use of 17up17down and the family of apps and stores we operate (collectively, "the Service"). By accessing any part of the Service — for example, creating a trip in LoonStruck, joining a challenge, or browsing the merch store — you agree to these terms. If you do not agree, do not use the Service.
17up17down is operated as a sole proprietorship based in Ontario, Canada.
17up17down is a family of small, playful apps for groups, cottages, camps, pools, and getaways, operated from 17up17down.ca. "The Service" refers to the 17up17down website together with the apps and stores we operate, which currently include:
New apps may be added over time and are covered by these terms once released. Most apps are accessed via a web browser — no app store installation is required. Features, plans, and pricing vary by app and are described within each one; where an app offers a paid plan, it adds features such as AI-generated content and expanded access on top of its free tier.
Several apps in the family — such as LoonStruck, The Pursuit, and Backyard Splash — use an organizer-and-guest model. Where an app works this way:
Organizers create trips, set passwords, and are responsible for the configuration and use of their trip group. By creating a trip, you accept responsibility for ensuring your group members are informed about how the app works, including AI content generation.
Guests access trips via a shared link and group password provided by the organizer. In LoonStruck, guest registration requires a name and a 4-digit PIN, and you are responsible for keeping your PIN confidential.
The Pursuit participants register with their name and organization on their own phone; there is no PIN. Teams are assigned by the app, not chosen by participants. Each team races on a single phone, and the first teammate to claim that phone becomes responsible for it. Everything submitted from a team's phone is treated as submitted by that team. Photos and videos you submit must be of your own team and must not include people who have not agreed to take part.
You must not share trip access links or passwords with people who are not intended participants of the trip. Trip groups are private by design — circumventing that is a misuse of the Service.
Some apps in the family — notably LoonStruck — use artificial intelligence to generate content including the Morning Bugle, Radio Report, recipes, quest judgments, setlists, local intel, and award citations. By using the Service, you acknowledge and accept that:
Content rated above PG (adult or x-rated settings) is explicitly enabled by the organizer and represents a choice made for that group. We are not responsible for content produced at a content rating level that the organizer selected.
You retain ownership of content you submit (photos, messages, quest submissions). By submitting content to the Service, you grant us a limited licence to store, display to your trip group, and use that content to generate AI features (such as including trip activity in the Morning Bugle prompt).
You must not submit content that:
Content is shared within your trip group only. We do not display user-submitted content publicly. We reserve the right to remove content that violates these terms.
Paid plans are priced per event or per season, depending on the app. Payment is processed at the time of purchase or trip creation. Physical merchandise is priced per item. All prices are in Canadian dollars (CAD) unless otherwise stated.
Because most apps deliver digital content immediately upon payment (trip provisioning, AI feature access), refunds for digital plans are not available once a paid plan has been activated. If there is a technical failure that prevents you from accessing paid features, contact us and we will make it right. Physical merchandise follows the return terms shown at checkout in the merch store.
We reserve the right to change pricing at any time. Price changes do not affect trips already purchased.

We reserve the right to terminate access for any account or trip group that violates these terms.
We provide the Service on a best-effort basis. We do not guarantee uninterrupted availability. Planned maintenance, server issues, or third-party provider outages (including AI providers) may cause temporary unavailability of some or all features.
We reserve the right to modify, suspend, or discontinue features of the Service at any time. AI providers, third-party data sources, and the features that depend on them may change. We will make reasonable efforts to maintain core functionality for active paid trips.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, that AI-generated content will be accurate or appropriate, or that the Service will meet your specific requirements.
AI-generated content — including the Morning Bugle, Radio Report, recipes, awards, and all related features — is generated by third-party language models. We make no representations about the quality, accuracy, or suitability of that content for any purpose.
To the maximum extent permitted by applicable law, 17up17down shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to: loss of data, loss of enjoyment, or harm resulting from AI-generated content.
Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid for the relevant app, trip, event, or item, or $10 CAD if no payment was made.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Ontario.
We may update these terms from time to time. The effective date at the top of this page will be updated when we do. Continued use of the Service after a change constitutes acceptance of the updated terms.
